TERMS & CONDITIONS
GOVERNING USE OF
COMOX RECREATION COMMISSION FACILITIES

Users must comply with all applicable Fire By-Laws and Regulations. These regulations include (without limiting the generality of the following) using only fire-proofed stage props, not exceeding the seating capacity and keeping exits clear. Smoking is not permitted inside the facilities |

Adequate supervision is essential and Users are required to give this careful attention, and to be prepared to pay for any damage done and, if requested, provide evidence of financial responsibility (i.e. carrying of appropriate liability insurance as set out below). Persons attending any function in the facility must obey all reasonable directions of employees in charge of the building at that time |

All facilities are rented on an AS IS basis. This applies to suitability, condition, and service, and there is no obligation other than provision of facilities as they exist at the time of the rental. |

Additional charges to cover necessary expenses may be levied if, following a User's occupancy of facilities, additional custodial or maintenance service are required as a result of litter on the premises or the premises being left in an unacceptable condition |

Equipment is not normally included unless prior arrangements for use of such equipment are made. |
| 6. |
There will be no responsibility assumed for any property left on the premises by the User. |
| 7. |
The following activities will not be permitted:
(a) Illegal activities.
(b) Any activity likely to cause damage or such as might bring the Comox Recreation Commission or Town of Comox in disrepute( as determined in the sole opinion of the Recreation Director or his designate).
(c) Absolutely no confetti is permitted in the facility.
(d) No smoking in any Comox Recreation operated facility

Security deposits are non-refundable and are required at time of booking |

It is the User's responsibility to ensure that all necessary permits are acquired and the condition of these permits are adhered to. |
| 10. |
The User shall at its expense, throughout the term of this agreement, maintain and pay for a comprehensive general liability insurance policy or policies with a limit of not less than $2,000,000.00 inclusive per occurrence for bodily injury and property damage. The Comox Recreation Commission and the Town of Comox will be added as an additional named insured on this policy or policies and the User shall supply the Recreation Director (or his designate), with adequate evidence of such insurance coverage by way of certificate or certificates of insurance policy or policies. Notwithstanding the provision of such insurance, the waiver indemnity provisions on the front of this agreement with still apply to the User |
FAILURE TO COMPLY WITH THESE CONDITIONS CAN RESULT
IN CANCELLATION OF THE USE OF THE FACILITY
